court fees depends on relief claimed and not on property market values

11-Jan-2023 (In Property Law)
Sir, I wanted a legal advice, in our Patron property, in the partition, Grandpa has given us a 3-foot street to come but it is encroached by my cousin, so I had to file a case against him and I in my Plaintiff The justice fee has been imposed by putting the value of the property as 1000000 and showing the value of that street as ₹ 800, but the counsel for the front party has applied the application of Civil Code 1908 of Order 7 Rule 10 11 on which they have filed the suit due to the reduction in justice fee I have given a reply to dismiss, on which I have decided the Chhattisgarh High Court in which the justice fee applies to the relief and not on the market value of the property, the ruling of the High Court has also been given. If I reject due to deficiency, what should I do in this case, please give legal advice?
