coparceners right in recoverd immovable property in huf
04-Aug-2023 (In Property Law)
a shop is recovered by a coparcener by a court order, for which other coparcener have accepted it that they have lost it, now after getting it back other coparceners hav started construction on it ,,can the one who recovered it stop them legally?
If the property belonged to all the coparcenary jointly and no partition had taken place yet then the person who has recovered the property from someone else, even if he did that alone doesn't become the sole owner of the property by virtue of that recovery. The property is jointly owned and any constructive on the said land can be done by the consent of all the coparceners.
