Clarification on share in grandfather's property

16-Mar-2023 (In Property Law)
Hi, Im a Hindu Boy. My GrandFather had 4 sons and a Daughter, He bought a 2400sq ft plot in Lucknow and did the registry into 1/2 with my unmarried Bua(Grand-Father's Daughter) and Uncle(Grand-Father's son). After a few years my Bua died. My Grand Father issued a Will But he didn't mentioned that plot as his property in the will. What will happen to plot? would it be considered as my Grandfather's property? or My uncle will have a legal claim as both my Bua and Grand-Father are no more? or It will be distributed equally among the 4 sons?

The land was purchased by your grandfather so he was the rightful owner of property and now if the same is not mentioned in his will then share will be equally divided between his sons and daughter. A Declaratory Suit (Regular) for partition shall be filed by all heirs before Civil Judge Senior Div Lucknow. You shall then be liable to register the new deed and pay stamp duty accordingly.
