Clarification on sale of property by co-owners without consent
05-Mar-2023 (In Property Law)
Grand father purchased two side by side adjacent plots with two titles in the name of his two sons and built one house..Both son expired and there family occupied half half of both plots.Nagarnigam no to pay house and water tax is one since 1956.Can one family sell his plot witout consent of other. Is this acase of two saperate property. Joint property. If one triesto sell what can be done.
In your case property is name of two persons but house is one and this is undivided joint property. Hence in this case one family can not sell the property with out consent of the other family if they want to sell then they it's requirements to firstly to offer to your family if you denied then they can sell the other person. If they sell with out consent then you can file a civil suit in the compent court.
