claim on grand fathers property

hi, My grandfather had ancestral fields to his name and he died without making any will.The property is now divided in all his 5 sons in equal parts now.My father is still alive and since he is wasting money on drinking ,Can i as a grandson claim my share in the property from my father.

No you cannot claim a share as long as father is alive if it was the self acquired property of your grandfather but you can claim share in the property being a coparcener if it is an ancestral property. If your father is wasting money out of that property then you can file a case of maintenance under section 125 cr.p.c. where by you claim that your father is not maintaing you and seek some amount in maintenance to prevent wastage of money.
