claim om my husbands self acquired property
31-Oct-2023 (In Property Law)
I was first married to a person an had a daughter from him later I had my divorce after 2 yr I got married again but the person I married again did not adopt my child legally but promised to give name to the child and take her responsibility till marriage .
so in this second marriage I have a daughter from my second husband ,recently my husband expired and willed the property to his biological daughter .
I agreed with him in this decision
So will there be any issue in claiming for ownership .
Also is my daughter from first marriage entitled to claim on that property does she has the right?
There is no legal adoption.also my husband has fulfilled the promise he gave and now as it is his self acquired property and want to give to his biological child I agree with him .
So is there any issue my first daughter can creat or claim om property does she has the right to claim on it?
If I do the process to execute the will to my second daughter .
Can she claim on it .
Yes definitely she has right in the self acquired property of your second husband. Even if she is not biological daughter of your second husband she will have same right as to your daughter from your second marriage. You can't make will as property does not belong to your name.
