Case running between me and neighbor for wrong demarcation

Sir, there is a case running in court between me and my neighbor for five years. My neighbor has filed the against case me on the basis of wrong demarcation. But he fails to provide any evidence in court for 5 years. I don't know why court is taking so much of time. Now I'm facing a very serious and dangerous problem with a tree. This tree is just with my rooms foundation and in disputed area. Now this tree' roots are damaging my rooms foundation so badly that my room can fall at any time and can cause major causality, my rooms wall is also get damaged.. Please suggest me what to do???
