Case of eviction filled against uncle, what are the chances of winning

my grandfather has a self acquired property which was gift settled to my father, now my uncle tresspassed into 1st floor of house and claiming that he has invested in construction of first floor,FIR was registered and we filed eviction, what are the chances of our winning the case? or incase if my uncle had sent amount which would be a meagre (30k) wat are the chances?
if the property has been gifted to your father by your grandfather and the gift deed has been duly executed than your uncle has no right over the property as it was your grandfathers self acquired property, if the title papers are in your name than you have a good chance to win the eviction suit
