24-Jul-2023 (In Property Law)
undivided property 2 owners, i am 50% co sharers in this entire property. can i alone serve eviction one of our tenants. original tenant and wife expired now 2 sons enjoy this said property with rent controller act. Younger son not staying with them from long time, after original tenants death he is now staying with his elder brother. first i remove younger son and serve a notice for eviction. can i do it alone . i also pay tax in my name with another cosharers. please advice.
Since you are the half share holder you neither can proceed with the eviction nor can file a case for eviction with respect to the entire property unless authorized by the other owner. However you can pray for eviction with respect to your half share from the property and accordingly can serve legal notice thereto and proceed with the eviction which will be less complicated and legal as well. All the best. Regards
