Can siblings claim share in property if not mentioned in will
27-Apr-2023 (In Property Law)
My father written a will mentioning that his hard earned property belongs to me after his demise. My other three siblings are excluded from this property. He also mentioned that my mother could change according to her wish later on. My father expired 8 yrs ago. My mother, based on the will she gifted the property to me and got registered. My sister is claiming a share in the property. Can she legally claim this property? Please advise
The will made by your father was a conditional will and the conditions clearly stated that you are the owner of the property after his death. However your mother had the power to change the ownership of the property if she wished to which she did not. Hence, in the present case, you can get the will probated and the entire property of your father would be transferred to you.
