Can self acquired property in name of mother be disposed by her
05-Jul-2023 (In Property Law)
My fathers was a retired govt Staff. And my father as 3 sons( 2 married) 2 Daughter's(married). All the properties bought by my father in my mothers name. Our own house also in my mothers name, the house was initially in my grandma name , after her death it is transferred to my mom name. My concern is If my mother can sale or transfer the property, house to any body without my knowledge. If it is possible, then how can I object these. My point is without my knowledge the property , house can't sale or transfer.
From the facts that you have stated above, it is clear that all the properties are in your mother's name and nothing has come to or to her by way of succession. In this scenario, the entire property becomes her self acquired property and she can dispose the entire property as per her wish without any interference from you or anyone else as all the properties come in the category of self acquired property and not ancestral property.
