Can RWA get management control over a public park from school?

Hello, There is a public park in our colony. Government authorities have given its maintenance right is given to a school adjacent to it. They have done nothing to maintain it last 10 years. There isn’t even grass on it. It’s like a mini desert. However they have a toilet and parking area in the park. They also keep on giving the park to various organisations for holding festivals and shows which create nuisance to the residents on daily basis. No idea if they receive monetary grants on giving the park for organising various shows and events. There used to be a road between the park and school. However, they’ve boundary walled park in such a way that the road has been encroached in their school too. Public authorities are of no help because of the political influence the school owner has. Our colony association has tried enough. We wish to find a suit to get the control. Can the judiciary help us? meanwhile, what action can we take to put curb noise pollution? regards

Yes, you can approach the municipal authority initially asking them to take necessary steps in the matter. in case they do not take any necessary action then you can approach the court by way of Public interest Litigation (PIL) or file a writ petition of your grievances
