Can husband sell land without telling wife ?
09-Feb-2023 (In Property Law)
Under the Protection of Women from Domestic Violence Act, 2005, a wife who has invested in a property and is living in it can seek protection against its sale by her husband. The Act recognizes a woman's right to reside in a shared household, which includes a house owned by the husband or his family and where the wife has been living, regardless of whether or not she has any right, title or interest in the property.
If the husband is attempting to sell or dispose of the property, the wife can approach the appropriate court and file an application for a protection order under the Domestic Violence Act. The court may then issue a protection order restraining the husband from selling, disposing or alienating the shared household, and may also direct that the wife's right to reside in the property be protected.
It is important to note that the Domestic Violence Act provides for both civil and criminal remedies, and a wife can seek legal recourse under both. The Act also recognizes that economic abuse, which includes denying a woman her right to property or assets, is a form of domestic violence, and provides for appropriate remedies.
Therefore, if a wife feels that her husband is attempting to sell a property in which she has invested and is living, she can approach the appropriate court and seek protection under the Domestic Violence Act.
