Can family member be my witness in property transfer from friend

Hello Team, I purchased a plot for 5 lacs but didn't register it on my name because of divorce case going on , so my friend has registered it on her name and ask to sign MoU on stamp paper where it is mentioned that I can anytime sell or transfer the owner ship on my name So can my family member be witness for me while I sign MoU with my friend on stamp paper ?

No,
such conditional Mou cannot have legal value.Because it is your benaami transaction.You can do agreement to sell with your friend stating period of sale deed execution.Thereby you can get possession of plot and can have legal claim on that property.
