Can an ancestral property be divided without consent of all legal heir
13-Jul-2023 (In Property Law)
I am unmarried muslim women ,My father had 9 surviving childrens.3 sons and 6 daughters. One son and four daughters are married as per muslim marriage act while one daughter married under special marriage act.we have a house and a piece of ancrstoral land on my fathers name.My parents are dead and i was living with my two unmarried brothers and a married sister in our fathers house. Both of my brother died in the span of two months. Now my sister is asking me to leave the house as she is claiming my elder brother gave his share to her.she claimed that she had a document where my three brother divided my fathers property among themselves equally to which i am not aware and the share of my elder brother who was unmarried now belongs to my sister. My questions are:- 1.Is it possible for my brothers to divide the whole property among themselves without my signature or my other married sisters consent. 2.What are my rights since i am unmarried and was being taken care by my dead brother?
you have a legal right on the property as per ur share and more over there is not any legaly partition in the property so the share of ur dead brother willl be divided between all of them..
