Builder harrasing the old land owner what legal action can be taken

My mother entered into an agreement in 2011with an person he asked to run hotel he it self constructed and gave 5 laks as advance and.my mother also returned 5laks to that person itself where he threatned her and got signature in agreement the rent fixed was 1.0lacs where he constructed itself and demanding my mother to pay cost of construction via detucting in montly rent where as she is old lady they have threatned the amount of 5laks was given in cheque to him how to evict him without rent control act where as the rent agreement becomes unusable because the advance amount was returned can i lodge complaint against him under criminal tresspass and also not paying rent what is short way she is fully suffered. What should I do?
