Brother in law refused to leave paid for construction but no rent paid

31-Dec-2023 (In Property Law)
From 2007 my brother-in-law lived in our house. He wanted to build a portion on our building to stay for a period of 8 years. I agreed for it and constructed a portion for him and his wife. He gave me Rs1,60,000/- for construction and construction costed around Rs2,20,000. They lived for 10 years without paying any rent. Matters between him and my family got bad and we asked him to leave. But he refused to leave. So we approached our area society and they made him to vacate the place. Now he is demanding for 1 lakh rupees from the money he gave for the construction. He is forcing the society head for the money. The head in turn forcing me to settle the matter. Now do I actually need to pay any money to my brother-in-law. Hoping for a valuable reply..

Hi,
Is it that you have given an written undertaking to him and do any undertaking is given by the society head to him. If their is any undertaking then you have to abide by it if not he has an option to go court and he can file a case against you for recovery of money. If their is nothing in writing then you or the society need not bother and nothing can be made out by your brother-in-law.
