Bought a property which has a charge on it

I have purchased an ancestral property from the daughter of a Hindu family. Her father has not written any will and she has purchased the property from her brother. Problem : Her brother has borrowed some money from a party and he did not return the same. So, the party has filed a case in the court against him with a promissory note claiming the property sale is not valid and he needs the money back from her brother. Her brother have two minor twins and she has a daughter and son. Please suggest how to deal in this case ?

HI,
Firstly we have to go step by step whether the property you purchased was from the person who is entitle to sell it to you legally. Secondly if the brother has sold the same to sister was it before the money been borrowed or later stage, dates are very important to come to conclusion. As you have to see the facts of the case and as you are not in the property you have to get your self implead in the suit to avoid any adverse judgement against the property.
