Hi,
Me and my wife hold a joint residential property in our name both having 50percent share each and which is under bank mortgage and presently that property is unoccupied on the other hand my wife left me in 2017 and filed domestic violence case against me at her home town, all this while i was paying huge amount of EMI and interim maintenance and now i m completely exhausted.
Is there any solution that she start paying her share of EMI or can i legally separate share of my property.
Yes it’s possible to file for partition suit between two people irrespective of DV and she is completely liable to pay her dues when she is taking portion of the property and hence for that I need to know the facts and what all cases have been filed in the court of laws
