Ancestral property claim can be raised

03-Dec-2023 (In Property Law)
My grandfather split marketvalue of his flat in 4 parts viz. his, his wife, his two sons. One son is given his share and asked to move out. Other son stays in that flat. This was 20 years ago. Today all four in whose shares were made are no more. Does grandson (who was asked to move out) have any claim on that flat. - No formal agreement, registration while making four parts. - Other sons family has literally got 3 parts of said flat. Do the claim can be raised?

This is my response to you:
1. Firstly you can send a legal notice and stake a claim and share in the flat;
2. If the person in possession refuses to then approach civil court;
3. File a partition suit in the civil court and stake your claim;
4. Consult a local lawyer and take steps.
