ancestor property need partition

Hello, Our grand father has three childrens in which the land has been equally partitioned "orally" by front portion(road), middle portion and last portion with a common way. in the middle portion the second son built his house 20yrs before. Now the last son who try to build house in front portion with proper registration, but the 2nd son who changed property tax and eb into his name without our knowledge which is in our grand father name. As he changed everything into his name is there any problem ?? he is not willing for partition, How can I get partition now

yes you will get the share, but have to file a suit for partition, and all the property belonging to your father can be partitioned by way of court order, merely changing the name in the eb cannot claim to be the right of that person so you have to file a suit for partition
