Remedy against insurance company if amount not refunded

I have renewed this year vehicle insurance with Bajaj before the expiry of policy, prior effective date i got a good deal from other insurer hence i made an inquiry and dropped a mail on cancellation procedure 2 days prior effective date 23rd June (policy effective from 25th June). it took longer than expected to get a response at last they responded that they would retain 3rd party premium and balance will refunded post deduction however till now they not able to explain me the calculation nor given the breakup. on 28th July i have taken duplicate policy from TATA and made a request to bajaj to refund my entire amount as i have sent enquiry mail prior effective date hence there should not be any significant deduction and now that i have taken alternative policy it should refunded completely or with very minimal charges .To my surprise till now their response was not specific and calculated basis on pro-rate refund amount including 3rd party 13840/-can i file a case against bajaj?
Yes, you can file a case against the Bajaj Insurance Company for claiming refund of amount. But it is advisable that before filing the case you should serve the company with a legal notice requiring them to make a refund of the total amount paid by you within the time period stipulated in the notice. It will be better to serve the legal notice first because there are chances of settlement of dispute at this stage only which helps in saving time and money. In case the company don’t comply with the legal notice then you can file a suit before appropriate Civil Court or a Consumer Court for claiming refund of the amount.
