Hello to all, I had an accident with uninsured vehicle. First he demanded 3 lakhs rs, which we can't provide. Later on he filled a fir against me under 279,337 which will be convert into 279,338 . Now Under the new provisions of mv act, how much compensation he will get for grievous injury and from whom as vehjcke was uninsured. Vehicle is registered against my father s name. And We are not capable of compensate much as I am the sole bread earner of my family and earninge much less. what willl court do if we can't compensate him. Will it falls under contempt of court. Compensation under MACT Act depends upon many factors of the party suffering from it. Person who is hit by the vehicle is of how much Age, his qualification, education and professional skill and his contribution to family concerned, his future earning power effected by the accident and his own social status etc. For its calculation there is a calculation table in the act to assist the court for its final determination.
Now come to the part where accused person is not able to provide compensation ordered by court to the suffering applicants. in this situation the amount will be derived under the land Laws where his property can be auctioned yo pay the compensation and if by this also they can not earn ghe equal amount the accused to be sent to jail for the term determined by the executing court.
