Death by motor vehicle - regarding insurance claim

My father in law died in motor van accident one week back. The vehicle has no insurance. Police registered a case. How can I claim the insurance? He is 67 years old. What are the procedures I have to follow? Please explain.
u go to mact court for filing A petition aganist driver and rc owner of the vehicle and also u filing a vehicle details occuring the accident any further clarification u can call me I will explain the mode of filing the mact court
