Bail granted to Lakha Sidhana in Red Fort Violence Case by Delhi Court
July 31, 2021Anticipatory Bail has been granted by a Delhi Court to the alleged gangster turned activist Lakha Sidhana in relation to the infamous Republic Day violence case. The accused has been granted bail with the help of lawyers he was represented by, including Advocate Jaspreet Singh Rai, Jasdeep Dhillon, Vir Sandhu, Ajitpal Singh Mander, Nitin Kumar, Kapil Madan and Gurmukh Singh.
Judge Kamini Lau, Tis Hazari’s Additional Sessions Judge granted bail to Sidhana, observing that he has joined the probe. The bail has been granted after his interim protection from arrest had been expired, which was extended by the court earlier. He was granted interim protection from arrest till July 3, which was extended till July 20 and then extended further.
The said anticipatory bail has been opposed by the Delhi Police, as they allege that he was a gangster and is not a farmer. Advocate Jaspreet Singh Rai however stated that Lakha Sidhana is a farmer and an activist and that he had no role in the Red Fort incident. He also stated that the Police had admitted that Lakha never entered Red Fort on January 26, 2021.
It was noted by the Court that the accused, Lakha Sidhana had joined investigations before the I.O. (Investigating Officer) on 21st and 25th July and had also produced his mobile phone being used by him on 26th January for recording videos.
Sidhana was granted bail on furnishing of a personal bond of Rs. 50,000 with one local surety of similar amount. The Court also directed him to appear on the last Saturday of every month, before the local police station Phul in Bhatinda district in Punjab, till the filing of the chargesheet.
An FIR had been earlier registered by the Crime Branch of the Delhi Police in connection with the violence broken out at Red Fort on 26th January under Sections 147, 148, 149, 152, 186, 353, 332, 307, 308, 395, 397, 427 and 188 of the Indian Penal Code, read with Sections 25, 27, 54, 59 of the Arms Act and Section 3 of the Prevention of Damage to Public Property Act 1984.
A Rs.1 Lakh reward had been announced for information regarding the whereabouts of Sidhana earlier. Deep Sidhu had been named as the primary conspirator in connection with the aforementioned FIR, however, bail had been granted to Sidhu in April 2021.
