​Bom HC imposes 3 lakh penalty to woman for filing false case seeking a girl's custody

A penalty of Rs 3 lakh has been imposed on a woman by the Bombay High Court for filing a false petition seeking custody of a girl who was rescued from a brothel. The woman claimed to be her biological mother, however, her real intention was to force her into prostitution business. In order to prove her claim the woman also showed fabricated Aadhaar and PAN cards. The Court had directed the woman to deposit the cost with the High Court registry after which an amount of Rs. 1.90 lakh was deposited on October 15th, Tuesday. In the present case, the woman had filed a petition for producing the girl, aged about 20 years, alleging that she has been detained by the Child Welfare Committee and is kept in the Children's home. She had requested the Court to release the girl and hand her over to her. She had further asked for compensation to be paid to either her or the girl of Rs. 5,00,000 for illegally detaining the girl. In furtherance to this, the Court gave directions for the production of the girl who gave a statement that the woman was not her biological mother. The Court then ordered a DNA test which showed that the woman was not the biological mother of the girl. Thereafter, the HC was informed by the Additional Public Prosecutor that the documents submitted by the woman were also fabricated after which the HC asked the woman to file her reply against the same. The woman in her reply stated that she does not want to pursue the case and would like to withdraw the same to file appropriate proceedings as per the law. The Court found that the woman had approached the Court with an ill intention of seeking custody of the girl to throw her into the flesh trade. It stated that the woman had filed the petition to abuse the procedure of Court while also showing the audacity to claim compensation of Rs. 5 lakh on false grounds. Moreover, the Court also directed the police to examine the registration of offense against the persons who helped in fabricating the government identities.
