Karnataka HC denies relief to law student who couldn't finish course in 7 years

November 25, 2018

The Karnataka High Court has denied relief to a law student who failed to complete his LL.B course within the prescribed period of seven years. The petition was filed by a student from the JSS Sakri Law College, Dharwad who is a 3 years LL.B course student. The student had enrolled in the year 2011 and had approached the HC after the college didn't allow him to appear for an exam for an optional subject of 5th semester. The student had relied upon the regulations of the Karnataka State Law University governing the three years legal course. The regulation permits candidates to have an extended period of two more consecutive attempts if they are unable to complete the course within six years. The university, however, relied upon an earlier judgment passed in R Manoharan v. The Karnataka State Law University, in which the HC had relied upon a circular issued by the university clarifying that a maximum period of seven years was available to students to complete the course. The Court, while taking note of the judgment, has stated that the student cannot be permitted to take up the law examination and has dismissed the petition filed by him.
