Man sentenced to 5 months imprisonment for molesting a colleague

A Delhi Court has upheld the sentence of a man who was charged for molesting a female colleague on finding the testimony of the victim to be trustworthy and lacking any ulterior motive. The accused had been sentenced to undergo imprisonment of one year by the Magistrate Court, however, the Court has changed it to five months due to his familial responsibilities. The woman had filed the complaint on February 25, 2016 in which she has stated that the accused and she used to work in the same company and the incident took place when the woman had to use the washroom on the other floor of the office as the one at her floor was unhygienic. It further states that the accused accompanied her to the washroom as he had to shut the office. The complainant had alleged that the accused then grabbed and assaulted her to which she retaliated by slapping him and reported the incident to the Human Resource department. Later, he was caught by two other colleagues while he was trying to escape. The police were then reported about the incident and a complaint was filed against the man charging him for using assault or criminal force against the woman with the intent to outrage her modesty under the Indian Penal Code. The accused, while denying the charges has stated that he had touched the complainant when he stumbled on the stairs. The accused has also argued that the first person whom the girl had approached after the incident has also not been made a witness in the case. However, the Court has denied his plea while finding it of no consequence and has upheld his conviction while trusting the woman's testimony and stating that she had no past enmity to depose against the accused.
