Women are not innocent gullible victims in all scenarios: Delhi Court

July 16, 2018

Amongst the increasing cases of false complaints of rape, sexual harassment and other crimes filed by women, the Delhi Court has stated that women cannot be treated as innocent victims in all situations. The Court has given this judgment in a case where a woman was found guilty of producing false evidence and filing false complaint of sexual harassment against her employer and subsequently withdrawing her complaint given to the Court and the police without giving any valid reasons. The woman has denied filing any complaint or producing any evidence before the Court. The Court, after carefully investigating the case, has acquitted the employer and has charged the woman under the Indian Penal Code for filing false complaint and producing false evidence in the Court. The Court has noted that the woman intentionally lied and disregarded her legal obligation to speak the truth before the Court. The Court has also stated that it cannot turn a blind eye to the actuality of hostile witnesses and false cases filed by women relating to sexual crimes across the country and that such witnesses should be dealt with in a strict manner. The Court has further stated that instead of standing as a silent spectator, every reasonable effort should be made by the Courts in such false cases to find the real facts or truth.
