Government plans to confiscate passport, bank accounts of NRI husbands who desert their wives
June 14, 2018In a bid to comfort wives in distress, after their NRI husbands assure a promising lifestyle, but soon desert them, a group of ministers has identified measures that can be taken to control their menace.
The government is aiming to bring changes in the law to empower authorities to confiscate an absconding NRI husband's share in a joint account and prevent the alienation of land held commonly by the partners. The idea is to curb mischief of such husbands and put some pressure on them, who refuse to answer Court summons.
One of such measures includes setting up a website by the Ministry of External Affairs, that would enlist unanswered summons. A summon would be deemed to have been served once it appears on the website, in case the husband facing legal action tries to evade or refuse to answer these summons. The government is also considering revocation of passport as another measure.
Recently, the Ministry of Women & Child Development had also suggested registration of NRI marriages within 48 hours of the marriage, which has now been put on the fast track for consideration.
The idea will be under the Cabinet scrutiny before taking the shape of a formal proposal. The GoM will analyse its legal tenability as it would require amendments to the criminal laws as well.
