Madhya Pradesh High Court says wife has the right to know husband’s salary
May 28, 2018Upholding the rights of a wife in a marriage, the Madhya Pradesh High Court has ruled that a wife is entitled to know her husband’s salary.
The woman was claiming maintenance from her husband. In her petition she alleges that her husband is a very high rank official at BSNL and draws a remuneration of more than Rs. 2,25,000 per month. She sought the information from BSNL by way of an RTI. The RTI was however denied by BSNL. The matter was finally heard by Central Information Commission (CIC) which directed BSNL to provide the said information.
Challenging the CIC order, the husband approached the Madhya Pradesh High Court. It was contested that the man was a public officer and his salary was his personal information that cannot be sought under the Right to Information Act.
The Madhya Pradesh High Court while upholding the CIC order, stated that the court while disposing such petitions has to within its ambit maintain sanctity of a marriage, and a wife shall be entitled to know the remuneration her husband is getting.
