A woman cannot be touched without her consent- Delhi Trial Court
January 21, 2018In a path-breaking decision, the Delhi Trial Court awarded a five years jail term to a culprit for sexually assaulting a nine-year-old girl and also stated that no one can touch a woman without her consent. The court in its observation termed it unfortunate that women continue to be victimized by "lecherous and sexually-pervert" men.
The court also stated that a woman's body is her own and she has the exclusive right over it and all others are banned to touch her body, without her consent, for any reason whatsoever.
The court while regarding this as an unfortunate scenario said that the ‘right to privacy’ of women is not recognized by men in India and that they never think twice before making unwanted advances to satisfy their lust by sexually assaulting girls and victimizing them.
The court showed no leniency on the accused and imposed a fine of Rs. 10,000/- on him out of which Rs. 5,000/- has to be given to the girl. In addition to this, the court also asked the Delhi State Legal Service Authority to pay Rs. 50,000/- to the child.
According to the girl in her complaint, she was with her mother at the market near Mukherjee Nagar in Delhi when Ram (the accused) inappropriately touched her and tried to molest her. The minor had, however, immediately informed her mother and pointed to the accused after which he tried to flee from the spot. He was later caught by the mother with the help of people in the area.
