Supreme Court extends the deadline of Aadhaar linking with all schemes to March 31
December 15, 2017The Supreme Court on Friday extended the deadline of linking Aadhaar with mobile numbers till March 31, 2018. Earlier the deadline for mobile- Aadhaar linkage was until February 6, 2018. The deadline for linking Aadhaar with bank accounts, PAN and other 139 schemes and services was already extended till March 31, 2018.
The order was passed by a constitutional bench of Supreme Court headed by CJI Dipak Misra also comprising of Justice A M Khanwilkar, D Y Chandrachud, A K Sikri and Ashok Bhushan. The bench clarified that anyone who wants to open a new bank account will have to furnish their Aadhaar Card. However, if the person is a non-Aadhaar card holder then he has time till March 31 to enroll for Aadhaar and will then have to furnish it to the bank authorities. In the meantime, he can give his Aadhaar enrollment application to the bank authorities.
The government had in June issued a notification declaring that it is necessary to provide Aadhaar card for opening new bank accounts and mandatory for the existing bank account holders to link their account with Aadhaar till December 31, otherwise their accounts shall cease to operate. However, the Centre had informed the court last week that it is willing to extend the deadline for Aadhaar linking with bank accounts till March 2018.
The Centre also issued a notification on Wednesday extending the deadline of linking Aadhaar and PAN with bank account till March 31, 2018. However, no, changes were made regarding the deadline of mobile linking. Hence the court today extended the deadline for the Aadhar-mobile linking also. Senior Advocate K K Venugopal told the court that the February 6 deadline for mobile linking was in pursuance of a previous order of the apex court and the bench may consider extending it.
The present order of the apex court is just an interim order that will be in effect till the court decides on the constitutionality of the Aadhaar scheme. Several petitions have been filed in the Supreme Court challenging the constitutional validity of the mandatory linking of Aadhaar as being violative of the Fundamental Right to privacy. The court will be hearing the matter on January 18.
