Supreme Court denies urgent hearing in Hadiya case

The Supreme Court has refused to schedule an urgent hearing in the Hadiya case. A plea was filed by the father of Kerala based woman, who converted to Islam before marrying to a Muslim man.

In the present matter, a bench comprising of Chief Justice Dipak Mishra and Justice A M Khanwilkar and Justice D Y Chandrachud held that they will hear the plea on November 27 when the woman will be brought before the court for interaction.

In the previous order passed by the apex court on October 30 it directed that the woman should be produced before the court on November 27 for an interaction in the open court.

The father of the woman requested for in camera proceedings on the grounds that the matter was communally sensitive in nature. He also claimed that the radical elements could jeopardise the safety and the privacy of the daughter and the family.

Earlier the court said on 16th August said that it would speak to woman in-camera before passing any order in this matter. Later, this order was modified and added that the court will speak to her in open-court and not in-camera.

The Hindu woman has converted to Islam and later married Jahan. It is alleged that the woman was recruited by Islamic State's mission in Syria and Jahan was only a stooge. After the Kerala High Court annulled their marriage, Jahan approached the top court challenging the order and saying it was an insult to the independence of the woman in the country.
