Triple Talaq to be made a punishable offence: Govt likely to table a Bill in Winter Session
November 22, 2017Supreme Court has curbed the centuries-old practice of instant triple talaq. Under this practice, Muslim men divorce their wives by uttering talaq three times. This practice was extremely unfair to women. After three months of passing the judgment the government the has decided to take the first step to draft a legislation that will be making triple talaq a criminal offence. To bring this law into effect a Bill will be tabled during the winter session of the Parliament.
To draft an effective legislation, a committee of ministers is constituted. The committee comprises of Home Minister Rajnath Singh, External Affairs Minister Sushma Swaraj, Finance Minister Arun Jaitley, Law Minister Ravi Shankar Prasad and Minority Affairs Minister Mukhtar Abbas Naqvi.
There are reports claiming that despite the Supreme Court banning the practice of triple talaq it is still prevalent among Muslims.The apex court observed that this could be that either Muslim men are not aware of the Supreme Court ruling on Triple Talaq or they are not taking it seriously since there is a lack of deterrent punishment.
In a recent case, it has been observed that an AMU professor divorced his wife through Whatsapp and SMS and then the wife approached police. As of now, the police is helpless as no action can be initiated against the husband in the absence of punitive provisions in the law. After the introduction of legislation women will be directly able to approach police for redressal and strict actions can be taken against them.
