Property Law Videos - How to claim ancestral property in India

To claim an ancestral property the first step would be to define the nature of the property. It could be a self acquired property or ancestral property. Self acquired would mean that the ownership of the property was acquired due to his own efforts without any help from his mother, father or any other family members.

In this case if the father has died without a will then perforce the property is divided among his legal heirs such as the mother, brothers or sisters.

In case, the nature of the property is ancestral the daughter can only claim partition that too during the life time  of her father. Though, this is a very complicated process and it is advised only after looking into the case with depth and various other parameters are taken into consideration.
Also, there is Section 6 of the Hindu Succession Act which makes a woman an equal member but this again varies from case to case.
