Transfer of Tenancy Rights to Legal Heirs per Maharashtra Rent Act

Hi, Our family (Hindu) has lived in a rent controlled building in Mumbai for almost 60-70 years. The original tenant, my grandfather, passed away and the tenancy was transferred to my grandmother in the late eighties. Sadly, in the past few years we have lost my grandmother, my father (the oldest son) and my uncle. My father and uncle have lived in the flat all their lives. Currently, the residents of the flat my mother, aunt (uncle's wife) and my family. My mother and I have lived in the flat for over 40 years. My aunt has lived there for 10 years. Please advise on whether the tenancy can and should be transferred to my mother or to my mother and aunt jointly. Also, is there any legal requirement for a NOC from all heirs?

This is my response to you:
1. Is this pagdi system?
2. If yes, then rent agreement has to be made;
3. Also, rent receipts needs to be transferred;
4. All the legal heirs of the deceased need to give their NOC if they do not wish to claim;
5. Consult a local lawyer with all the documents and then take the legal steps.
