Tenant refused to vacate the house

Sir,
I have asked to vacate my house to tenant this year January since they have not maintained well and no white wash for last 5 years, I want to repair and do white wash. But he is not ready to vacate. I would like to get your legal opinion on this, how and where to approach to vacate him.
So this month did not accept the rent and asked him for talk, he is telling he can pay to court. Is it possible? what documents he needs to pay rent to court.
