Regarding property Rental tenure
04-Dec-2023 (In Landlord/Tenant Law)
I own a property which is mine since last 30+ years. I have given it on rent since last 11 years to a guy who seems to be really nice, he pays his rent, keeps everything up to date and we are happy to have him as a tenant, we have been making leave license agreements with him every 3 years with all required registration of agreements and stuff. I have heard that if a tenant stays for more than 10 years he gets rights of it as half owner and that owner cannot remove him if he wishes to, is it true? What is the solution to avoid this scenario in case if this is true. I've been taking legal advice from local lawyers and changing the name of tenant every 3 years. is that enough?
This is my response to you:
1. Your problems begin if this person refuses to leave the premises;
2. Legally speaking, if you make an agreement for more than 12 months, then you should register them;
3. So it is advisable to make agreements for 11 months if you wish to save on registration;
4. Coming to the main point, he could stake a claim on the whole property and can seek protection of law from being evicted;
5. He could take you to court and prolong the issue;
6. You may consult a local lawyer and keep the L&L on rotation basis to different people.
