Procedure in case tenants are not leaving the house
10-Oct-2023 (In Landlord/Tenant Law)
my tenants are staying in our house since 15 years. now when we are asking them to leave the house as they are not paying rent since 1 year and because we want the house for our personal reasons, they are not leaving as well as behaving abruptly and defaming us in front of other people. they are demanding 5 lakhs for leaving the house because apparently they deposited 20000 security which is not true and they don't have any proof of it and even if they did(chances being 0%),they have caused severe damages to our property for which we'll have to renovate the whole house, for which we can deduct their security(which they didn't deposit). they do not let us renew the agreement also. they fight with us if we ask for that. they are paying 3300 since 15 years. we are being mentally tortured by them as we are helpless as all drama is being done by the lady of their family, even if we respond to them when they fight they call police and do drama that we started the fight. please help me on this
U can give ur tenant notice under section 106 of transfer of property act for determination of his tenancy and after expiry of notice period i.e. 30 days u should file rent recovery and eviction petition and claiming damages bcoz now that property can easily fetch on higher rent and u should adopt legal process for getting ur property back
