Plain paper agreement signed by a person, broker & the owner valid
15-Jan-2023 (In Landlord/Tenant Law)
Hello Sir / Madam, I am currently living in Bangalore.I and my friends were looking for a house for rent in Bangalore and when we finally found it, we carelessly paid a token amount to set the deal. We paid Rs 10000/- to the owner as a token to secure our spot and Rs 12000/- to the broker who arranged the meeting. The real mistake on our part was that we wrote on a piece of paper that we have paid Rs 10000/- now and that we will pay Rs 40000/- before 28th January 2018. Currently, we wish to not move into the apartment due to some reasons concerned with our employment. We are okay with losing the money we gave them. What I really wanted to know was if they could hold that piece of paper against us in any court of law. To give you a little more detail about the paper. The paper in which we signed doesn't have any stamp on it nor is it a white paper. It is a paper torn off from a ruled notebook. It was signed by me, the broker and the owner.
Here as per law con't be contest the court without stamp paper.,it is on a white paper then you will be asked to pay the actual stamp charges and the penalties on the same before accepting it as a document in courts. Anyway there is no illegality in having the agreement on a plain paper.
