Owner not refunding deposit amount what can be done

We rented a flat in mumbai from may 2015. Our rental agreement was over in april 2016 and we paid money to owner for renewal of agreement. We approached her many times to share agreement with me but she never gave the original agreement. She made many excuses and always said take it some other day. Now that our agreement was over for 2017 also she asked us to renew it with a condition that her daughter will stay with us. When we denied this she asked us to vacate the flat in 10 days. We vacated the flat with all things and cleaned the entire apartment. Now she is denying to give the deposit of 50k back stating painting cost and maintenance cost is to be deducted. Neither she is agreeing to share agreement with us

Firstly, send him a legal notice demanding payment of security deposit back within 15 days. And if the payment is not made within 15 days, then you can file a recovery suit for recovery of the amount of the entire security deposit. However, you shall have to adducing evidence to show the existence of the debt.

You can also register a criminal complaint against her in the nearest Police Station for the offence of cheating under Section 420 and for criminal breach of trust under Section 406 of the Indian Penal Code.
