Landlord not ready to return security amount

Hello I took a flat on rent at 22k per month. Got the papers done and paid 44k as security one month before possession. Just before possession, I had a family issue (grandmother's kidney's failed and she got admitted to ICU in Kailash hospital Noida) and i asked the landlord if i can back-out in good-faith He agreed and said tomorrow i will send you the security cheque. Its been a week now and he is delaying the matter, now saying you need to sign cancellation deed and pay the fee of 4-5k to his lawyer for this deed. While i need money, i feel its a bit of undue cheating as if he would have said no to refund earlier, i would not have backed out and shifted anyways. What can i do?
You will have look into the lease agreement as to whether there is any clause regarding the earlier cancellation of the lease, if not then you can send him a legal notice demanding the payment of the security deposit, if he still denies to provide you the same then, you can file a recovery suit in the civil court claiming the deposit along with the compensation also, you can file a police complaint for that purpose too.
