Landlord gave apartment in pathetic state & not returning sec deposit

House owner gave the apartment for rent in very pathetic state. During site visit, He promised to fix all the issues before possession. But, only after possession, I know that he hasn't fixed any of the issues. After possession also, he didn't respond properly for fixing the issues. So vacated the flat within short period. Now, house owner not returning security deposit stating that I have vacated before 11 months. He hasn't given me any Rental Agreement. But, I have made all transaction through net banking. What are my legal options? He is in Pune. But, his permanent address (he told me) is in Nanganallur, Chennai. Flat is in Padur. Where should I fail complaint (Pune/Nanganallur/Padur) against him?

In the absence of any written rental agreement between you and the house-owner, it will be difficult to prove the terms and conditions agreed upon by both parties. However, the house-owner cannot legally withhold the security deposit after you have vacated the flat. You may send him a legal notice demanding immediate refund. If there is no response, you may have to file a suit at a munsif/district court having jurisdiction over Padur.
