Writ petition against company declared illegal lockout without notice.

Sir I was to know that one company declared and 3 november as holidays and 4 November declared lockout without prior notice district labour commissioner issues a so cause notice against moserbaer management . company give a reply that lockout is legally because employee were on strike after 4 nov no payment and remuneration will be given but employee were not strike after that district labour commissioner send a report to up government that company declared illegal lockout but government not take any legal stand against company so what can I file a writ petition against Company in high court u.p. to restore salary after 4 November and peace n harmony at Company

As per the company mosebear is the private company, so the case shall put up in the labour court before an appropriate court under Section 17 of Payment of Wages Act which describe that those salary or wages are pending by the organisation to employee before the Appropriate Labour Court. As per the said act, Section 5 clearly shows that Time of Payment of Wages.
