Worked for 365 days can I claim legal gratuity

since July 1996 I am working for Family group concern. All this days I had signed maximum official papers with Governments and private. Involved in Sales and purchase on behalf the Companies. But in know place my attendance was maintained. The payments only by cash. we work all 365 days. No leave or leave benefit. Can I claim legal gratuity or settlement
