Whee can i complain for my full and final settlement

Dear sir/mam, I had been working with a pvt ltd company from 21st march 2016to 21 august2016, first of all the seniors ruined me in a political trap as i was new to the company and forced me to resign. Now when i resigned on 25th sept 2016. The hr told me to collect your payment in nxt 30-45 days. Its been more then 60 days i didnt got my salary. When i use to call the hr he didnt wants to talk to me and still asking for 20more days. I dont know when ill got my salary I threaten him by the name of consumer court , he said do whatever you want. I wanted to know that do i get my salary? What steps do i need to take to get my salary early as i requires the money for medical treatment. Please help me out with this issue. Thanks Tishya chandra

Please take note of following -
1. You need to send them a legal notice asking for your Full and Final settlement and for your reliving as per the employment agreement which you have with yourself and your previous organization.
2. If they fails to respond to the notice or fails to make any proper response to that notice then you are free to approach to the competent court of jurisdiction for the same.

Immediately contact a lawyer with full details of case Serve a legal notice to your previous employer After expiry of notice period file a recovery suit in appropriate district court Remember you have to pay court fees on amount claimed

I hope your medical treatment is on the right course.
In the limited conspectus of the facts disclosed above, the remedy that could available to you is to approach the Courts of competent jurisdiction demanding payment of salary.

Hi tishya you definitely liable to get your salary, first you gave a legal notice regarding your dues then approach the court and sue there. There is no other alternate to get your salary except to sue in the court .
