What to do when company not clearing dues of former employees

12-Sep-2023 (In Labour & Service Law)
I had worked for 6 months in a company and after leaving the company they are not clearing my dues which includes salary (2 Months) and PF (8 Months), I have 2-3 colleagues who are also having the same problem. I have taken some steps - I tried calling all the company representatives and senior level people. - I tried WhatsApp and emails as well. - I visited the company once but CEO told me to wait and then he won't meet me. - I speed post my request for salary two times as a reminder. Now, I want to take a legal step according to the rule and I have colleagues with me who are also facing the same problem, fighting alone is a better way or is there any way where we all can fire a legal action together?

My Response to your query :

Yes you can take legal action against your old company if not paying pending amount.
First you have to send legal notice to recover your amount.
If not received positive reply to notice you can file suit for recovery of money.

For More detail you may contact me.

Thank you

This is my response to you:
1. All you should contest the matter at the same time;
2. Firstly send a legal notice;
3. You can mention your claims etc.;
4. You can also seek compensation for the mental and monetary loss suffered by you;
5. Last step is to approach the labour court;
6. Alternatively you can also approach the civil court under recovery of suit;
7. Consult a local lawyer and take legal steps.
