What to do office immediately relieved applicant after courts orde

03-Jul-2023 (In Labour & Service Law)
Applicant filed OA in CAT court for transfer order cancellation. Interim relief denied by CAT but given 04 week time for department to answer querry in OA. Applicant filed writ petition in High Court and High Court gave directives to CAT to consider the case a fresh. Applicant promptly submitted the High Court decision to office but office after seeing this order immediately stand relieved the applicant. Now, my querry is whether this act by office amounts to contempt of court as the proceedings were alive and applicant promptly conveyed the same to office.

This is my response to you:
1. Yes it amounts to contempt of court;
2. The CAT should have heard the matter afresh;
3. The office cannot pass stand relieved order without enquiry;
4. A application should be made to the CAT that the office has acted ultra vires and the office order be rescinded.
