What to do if i feel there will be case of fraud on me
05-Jun-2023 (In Labour & Service Law)
I have a small ice cream parlour which I gave to Mr. X to run that parlour, in return he would give me some percentage of my sale. After doing business for 3-4 months Mr. X, said that he would not like to continue it, so we finalized the account and ₹8000/- were to be taken from Mr. x. Which he said that he will give in 10-15 days. I tried for a month to recover the amount, but he always said that he will give in 10-15 days. Two days before I again dialed his number and asked for the money, so he said that he will case on me that I have taken more money than the stock value and forced me politically to sign in the papers that this amount is to be paid and he has discontinued by his will. The papers were not the stamp paper, but yes I took sign on a normal paper where or the totals were made. Now, I am in here fear that will I be punished if he case on me.
This is my response to you:
1. You must send out a legal notice to him;
2. If he does not pay then you have no option other than filing a suit for recovery;
3. Whoever takes the first step in making a formal complaint will have the edge;
4. It is better that you send him a legal notice and make your side of the story concrete.
